Betting Regulation in Germany
Online sports betting in Germany is regulated mainly by the Interstate Treaty on Gambling 2021 (Glücksspielstaatsvertrag 2021 or GlüStV 2021). It came into force on 1 July 2021 and created a common regulatory framework for all 16 federal states. Sports betting taxation is governed separately under the Rennwett- und Lotteriegesetz (RennwLottG).
The main regulator for cross-state online sports betting is the Gemeinsame Glücksspielbehörde der Länder (GGL). Since 1 January 2023, the GGL has been responsible for licensing and supervising online sports betting across Germany. It also maintains the official whitelist of permitted gambling operators and domains. For players, checking the whitelist remains the simplest and most reliable way to verify whether an operator is legally authorised.
Players must be at least 18 or older, and licensed German betting companies must verify their identity and account details. Under Section 6a of the GlüStV 2021, limited provisional play may be permitted for up to 72 hours after registration before verification is completed, subject to a €100 deposit limit. Withdrawals are not allowed until the player’s details have been verified. These rules apply to people gambling from Germany, not only to German citizens.
Licensed sportsbooks must also take part in Germany’s central player-protection systems, including LUGAS and the OASIS self-exclusion register. I explain these tools and the applicable limits in more detail in the responsible gambling section below.
German regulations also restrict the range of betting products and markets that licensed bookmakers may offer. Sports betting companies in Germany may only provide sports, events and betting markets permitted under the regulatory framework. The GGL’s Sportwettprogramm defines which sports bets may legally be offered. As a result, German sports betting sites can have fewer niche or short-term betting markets than offshore operators.
Licensed sites operate under German regulatory supervision, and players can report regulatory irregularities to the GGL. However, the regulator does not resolve private civil claims such as requests for unpaid account balances or the recovery of gambling losses. The GGL explains this distinction in its complaints and reporting guidance.
Germany also applies a sports betting tax. Under the Rennwett- und Lotteriegesetz, the sports betting tax rate is 5.3% of the statutory tax base. Legally, the tax base is the paid stake minus the sports betting tax itself, and the sportsbook operator is responsible for paying the tax. The tax liability arises when the stake is paid, not when a player wins.
How this cost affects customers depends on the bookmaker. Some operators absorb it instead of deducting a separate betting charge from customers. For example, bet365 states that it covers the 5.3% betting tax for its German customers. Players should check each bookmaker’s betslip and terms because the treatment of betting tax can affect the effective value of a wager.
Using offshore betting sites carries additional legal and practical risks. The GGL advises players to check the whitelist because illegal operators can still look professional while operating outside German supervision. Participation in unauthorised public gambling can itself be a criminal offence. Under Section 285 of the German Criminal Code (StGB), participation in illicit public gambling can be punished by imprisonment of up to six months or a fine of up to 180 daily rates.
For bettors in Germany, the most reliable legal check is to confirm that both the operator and the betting domain appear on the GGL whitelist. Licensed German bookies must follow local verification, player-protection, betting-limit, and regulatory requirements that do not apply in the same way to offshore sites.

OASIS Self-Exclusion
For longer breaks, Germany uses the nationwide OASIS self-exclusion system. The Regierungspräsidium Darmstadt is responsible for the register, and licensed operators must check whether a player is excluded.
A self-exclusion normally has a minimum duration of one year, although players can request a shorter period of at least three months. A third-party exclusion, known as a Fremdsperre, has a minimum duration of one year. These rules are set out in Section 8a of the GlüStV 2021.
OASIS exclusions do not end automatically when the minimum period expires. The player must formally apply for the exclusion to be lifted. Under Section 8b of the GlüStV 2021, a self-exclusion remains active for at least one week after a valid lifting request, while a third-party exclusion remains active for at least one month.

Winamax showed mixed pricing. Its Bundesliga 1X2 margin was considerably wider than most competitors, but its Over/Under and BTTS pricing was much more competitive. bwin offered useful football features and promotions, but it also recorded the highest average live 1X2 margin in my comparison.
